Intoduction

This Privacy Policy outlines how ZAICA LLC. (d/b/a Zai Martial Arts) and its affiliates (referred to as “ZMA,” “we,” or “us”) collect, use, and share information from or about you, including personal information, in connection with your use of the Services. This policy applies to all users, whether registered or not, who view any content or use the Services. If you do not consent to the collection and use of information in accordance with this policy, you may not use the Services.

Please note that the Services may include links to third-party websites, and ZMA is not responsible for the privacy practices of those sites.

It’s important to note that this Privacy Policy does not apply to personal information of ZMA employees processed in the employment context or to the personal information of members collected at in-person ZMA locations. However, if an employee or in-person member uses the Services, they will be treated as users in accordance with this Privacy Policy with respect to personal information processed as users of our Service.

Chnages to privacy poicy and practices

This Privacy Policy may be subject to changes from time to time, and you will be deemed to have accepted the updated Privacy Policy if you continue to use the Services after the updated Privacy Policy is posted on the Services (as indicated by the “last updated” date). If you do not agree to any portion of the Privacy Policy, you must immediately stop using the Services.

We may change this Privacy Policy at any time at our discretion, so it’s important to review it periodically. Your continued use of the ZMA Site or Services after any changes have been made constitutes your consent to the changes.

If there are any significant changes to this Privacy Policy, we will notify you by email or as required by law. Any adjustments to the Privacy Policy will be posted on the web page, and the revised version will be effective immediately upon posting (or upon notice if applicable). Please check the ZMA Site regularly to view the then-current Privacy Policy.

If we plan to use personal information for a new purpose, we will inform you and give you the opportunity to opt-out, where required by law or contract.

Types of information we collect

The personal information that we collect and our privacy practices vary depending on the nature of your relationship with ZMA and the applicable law. We may collect personal information directly from you or from third-party sources, and some of the ways that we may collect your personal information include when you interact with our services, enter promotions or sweepstakes, purchase ZMA products, or participate in a studio class live or via our subscription services. Additionally, we may collect certain passive information about your visit, such as through cookies and similar technologies, as you navigate our services. We collect personal information from our current, prospective, and former members, registered users, and visitors to our site. The personal information we collect may include your email address, phone number, or mailing address when you request information about our services, participate in promotions or sweepstakes, or otherwise communicate with us. We may also collect other information from you, such as your in-person class attendance history and purchase history, to improve and provide our services. Please note that if you submit content to publicly accessible blogs, social media pages, review/testimonial pages, private messages, video chat, or community forums, such content will not be subject to the privacy protections provided in this Privacy Policy. We may also collect certain automatic data through our services or other web analysis methods, such as your IP address, mobile carrier, mobile advertising identifiers, MAC address, and other device identifiers. You agree that ZMA is free to use the content of any communications submitted by you via our services for any purpose, including developing, manufacturing, and/or marketing goods or services. Finally, we may receive information about you from other sources.

How we use information we collect

To Provide Services or Information Requested. ZMA may use information about you to fulfill requests for Services or information, including information about potential or future services, and including to:
  • manage Users’ information and accounts;
  • respond to questions, comments, and other requests;
  • provide access to certain areas, functionalities, and features of ZMA’s Services;
  • communicate with you about logistical matters, including notifying you of changes to our Terms or Privacy Policy;
  • provide Services to you; and
  • allow you to register for classes and other offerings.
Administrative Purposes. ZMA may use personal information about you for its administrative purposes, including to:
  • measure interest in ZMA’s Services;
  • improve the Services;
  • verify Users’ identity;
  • communicate about Users’ accounts and activities on ZMA’s Services and the ZMA Site;
  • Send emails or text messages to the email address or telephone number you provide to us to verify your account and for informational and operational purposes, such as account management, customer service, or system maintenance;
  • process payment(s) for Services or subscriptions;
  • prevent potentially prohibited or illegal activities;
  • maintain and administer our Services; and
  • enforce our Terms.
Marketing. ZMA may use personal information to provide you with materials about the Services and other offerings that may be of interest, including new content or services. ZMA may provide you with these materials by phone, postal mail, text or email, as permitted by applicable law. Such uses include:
  • to notify you about services and other offerings that may be of interest to you or about which you have previously expressed an interest;
  • to tailor content, advertisements and offers;
  • to provide Services to you;
  • for other purposes disclosed at the time that Users provide personal information; or
  • otherwise with your consent. 

You can choose to opt-out of receiving marketing communications from us at any time by following the instructions outlined in Section 9. If you provide us with personal information, either directly or through a third party, we may send you periodic emails, newsletters, mailings, text messages, or phone calls about our products, services, or special offers/events that we think may interest you. However, you have the option to decline these communications without any charge by following the instructions in Section 9.

ZMA and our third-party partners may use personal information and other data to create anonymous and aggregated information, such as de-identified demographic and location information, which we use to analyze visitors’ interests and usage of our Services. This information is not considered personal information and may be used for research, internal analysis, analytics, or other legally permissible purposes. We may share this anonymized or aggregated information with third parties, including within ZMA, to prevent anyone from identifying you.

If you use our referral services, such as “Refer a Friend,” you may provide information about your friends, which we use to send them content or links. However, we only use their email addresses for this specific purpose and will not use them for anything else without their consent.

Finally, we may use personal information for legitimate interests such as fraud protection, compliance with legal obligations, or other purposes that we disclose to you at the time you provide the information or with your consent.

 

Cookies, pixel tags/web beacons, interest-based advertising, and analytics information

ZMA and third parties that provide content or other functionality on the Services may use cookies, pixel tags, local storage and other technologies (“Technologies”) to automatically collect information through the Services. The Technologies are essentially small data files placed on your computer, tablet, mobile phone or other devices that allow us to record certain information whenever you visit or interact with the Services or ZMA Site, and to recognize you across devices.
  • Cookies. Cookies are small text files placed in visitors’ computer browsers to store their preferences. Most browsers allow you to block and delete cookies. However, if you choose this option, the ZMA Site and/or Services may not work properly.
  • Pixel Tags/Web Beacons. A pixel tag (also known as a web beacon) is a piece of code embedded on the ZMA Site that collects information about users’ engagement on that web page, e.g., that a user has visited a particular web page or clicked on a particular advertisement.
  • Social Media Widgets. The ZMA Site includes social media features such as links to Facebook, Instagram, Twitter, YouTube, and LinkedIn. This functionality may include widgets, such as a “share” button or other interactive mini-programs. These features may also collect your IP address, which page you are visiting on the ZMA Site, and may set a cookie to enable the feature to function properly. These social media features are either hosted by a third party or hosted directly on the ZMA Site. Your interactions with these features are governed by the privacy policy of the company providing it.
  • Analytics. We may also use Google Analytics and Google Analytics Demographics and Interest Reporting to collect information regarding visitor behavior and visitor demographics our Services and to develop new Content or Services. This analytics data is not connected to any personal information. For more information about Google Analytics, please visit www.google.com/policies/privacy/partners/. You can opt out of Google’s collection and processing of data generated by your use of the Services by going to http://tools.google.com/dlpage/gaoptout.
Our uses of the Technologies fall into the following general categories:
  • Operationally Necessary. We may use Technologies that are necessary to the operation of the ZMA Site, Services, applications, and tools. This includes Technologies that allow you access to the ZMA Site, Services, applications, and tools; that are required to identify irregular site behavior, prevent fraudulent activity and improve security; or that allow you to make use of functions such as shopping carts, saved search or similar functions;
  • Performance Related. We may use Technologies to assess the performance of the ZMA Site and Services to help us understand how our visitors use the ZMA Site, determine if you have interacted with our messaging/marketing, determine whether you have viewed an item or link, or to improve the ZMA Site, Content, or Services;
  • Functionality Related. We may use Technologies that allow us to offer you enhanced functionality when accessing or using the ZMA Site and Services. This may include identifying you when you sign into the ZMA Site or keeping track of your specified interests or past Content viewed so that we may enhance the presentation of content on the ZMA Site;
  • Advertising or Targeting Related. We may use first-party or third party cookies and web beacons to deliver Content, including advertising relevant to your interests, on the ZMA Site or on third party sites. This includes using technologies to understand the usefulness to you of the advertisements and Content that has been delivered to you, such as whether you have clicked on an advertisement.
If you would like to opt out of the Technologies we employ on the ZMA Site, the Services, applications or tools, you may do so by blocking, deleting or disabling them as your browser or device permits. See Section 9 for additional opt-out options. Please note that blocking, deleting, or disabling these Technologies will affect the functionality of the ZMA Site and Services, and may prevent you from being able to access certain Content or functionality.

Third party websites and social media platforms

The Service may contain links to third-party websites and social media platforms that may reference or link to the ZMA Site or other Services. Please note that these other websites and platforms are not under our control, and ZMA does not endorse or make any representations about third-party websites or social media platforms. We encourage you to review the privacy policies of every website and platform you interact with. We do not endorse, screen, or approve of the privacy practices or content of such other websites or platforms, and visiting them is at your own risk.

The Services may also contain links and interactive features with various social media or other platforms (e.g., widgets). If you use these platforms, their cookies may be set on your device when using the Services. Please be aware that any personal information that you voluntarily include and transmit online in a publicly accessible blog, video chat session, social media platform, or other online forum, or that you share in an open forum, may be viewed and used by others without any restrictions. We cannot control such uses of your information when you interact with a third-party platform, and by using such services, you assume the risk that your personal information may be viewed and used by third parties for any number of purposes.

 

Information we share

We may share your information as described in this Privacy Policy (e.g., with our third party service providers; to comply with legal obligations; to enhance the Services, to protect and defend our rights and property) or with your permission.
  • We Use Vendors and Service Providers. We may share any information we receive with vendors and service providers. The types of service providers to whom we entrust personal information include service providers for: (i) provision of IT, analytics and related services; (ii) provision of information and services you have requested; (iii) payment processing; (iv) customer service activities such as deliveries and member support; and (v) in connection with the provision of the Services. ZMA endeavors to execute appropriate contracts with such service providers that prohibit them from using or sharing personal information except as necessary to perform the contracted services on our behalf or to comply with applicable legal requirements, and this Privacy Policy.
  • Business Partners. ZMA may share personal information with our business partners and affiliates for our and our affiliates’ internal business purposes or to provide you with a product or service that you have requested. ZMA may also provide personal information to business partners with whom we may jointly offer products or services, or whose products or services we believe may be of interest to you. In such cases, our business partner’s name will appear, along with ZMA’s name.
  • Information Visible to Other Users. The content you post to publicly-visible portions of the Services, or portions of the Services visible to other registered users, are visible to such users. Other users of the Services may be able to see some information about you, such as your username, if you submit a review or provide a testimonial to the ZMA Site. We are not responsible for the privacy practices of the other users who view and use posted information.
  • Marketing – Interest-Based Advertising and Third-Party Marketing. ZMA may allow third party advertising partners to set tracking tools (e.g., cookies) to collect information regarding your activities on the ZMA Site (e.g., your IP address, page(s) visited, time of day). We may also share such de-identified information as well as selected personal information (such as demographic information and past purchase history) we have collected with third party advertising partners. These advertising partners may use this information (and similar information collected from other companies) for purposes of delivering targeted advertisements to you when you visit non-ZMA related websites within their networks. We may allow access to other data collected by the ZMA Site to facilitate transmittal of information that may be useful, relevant, valuable or otherwise of interest to you. This practice is commonly referred to as “interest-based advertising” or “online behavioral advertising.” If you prefer that we do not share your personal information with third party advertising partners, you may opt out of such sharing at no cost by following the instructions in Section 9 below.
  • Disclosures to Protect Us or Others (e.g., as Required by Law). We may access, preserve and disclose your personal information, other account information and content if we believe it is required or appropriate: 

(i) to comply with law enforcement or national security requests and legal process, such as a court order or subpoena;

(ii) to respond to your requests;

(iii) to protect yours, ours or others’ rights, property or safety;

(iv) to enforce ZMA policies or contracts;

(v) to collect amounts owed to ZMA;

(vi) to comply with records retention policies;

(vii) to prevent physical harm or financial loss or in connection with an investigation or prosecution of suspected or actual illegal activity; or

(viii) because it is otherwise necessary or advisable.

In addition, from time to time, server logs may be reviewed for security purposes – e.g., to detect unauthorized activity on the Services. In such cases, server log data containing IP addresses may be shared with law enforcement bodies in order to allow them to identify Users in connection with their investigation of the unauthorized activities.
  • Merger, Sale, or Other Asset Transfers. If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, receivership, sale of company assets or transition of service to another provider, then your information may be sold or transferred as part of such a transaction as permitted by law and/or contract. In such event, ZMA will endeavor to direct the transferee to use personal information in a manner that is consistent with the Privacy Policy in effect at the time such personal information was collected.

International data transfers

You agree that all personal information collected via or by ZMA may be transferred, processed and stored anywhere in the world, including but not limited to, the United States, Canada, the European Union, in the cloud, on our servers, on the servers of our affiliates or on the servers of our service providers. Your personal information may be accessible to law enforcement or other authorities as described above. By providing information to ZMA, you explicitly consent to the storage of your personal information in these locations.
Opt out rights; right to object to processing
You have the right to object to and opt out of certain uses and disclosures of your personal information. Where you have consented to ZMA’s processing of your personal information or sensitive information (a subset of personal information which, due to its nature, has been classified by law or by policy as deserving additional privacy and security protections, such as certain financial or medical information, and personal information regarding EU residents that is classified as a “Special Category of Personal Data” under EU law, such as: (1) race or ethnic origin; (2) political opinions; (3) religious or philosophical beliefs; (4) trade union membership; (5) genetic data; (6) biometric data where processed to uniquely identify a person; (6) health information; (7) sexual orientation or information about the User’s sex life; or (8) information relating to the commission of a criminal offense), you may withdraw that consent at any time and opt-out to further processing by contacting info@zaixma.com. Even if you opt-out, we may still collect and use non-personal information regarding your activities on our Service and/or information from the advertisements on third party websites for non-interest based advertising purposes.
Email, text, and telephone communications
You can unsubscribe from email, text and phone communications at any time. To stop receiving our promotional emails, follow the unsubscribe instructions in the email messages you receive from us or contact us as described in Section 15.
To opt out of receiving text messages, follow the opt-out instructions in the text messages that you receive from us. We will process your request within a reasonable time after receipt, in accordance with applicable laws.
Note that you will continue to receive transaction-related emails regarding products or services you have requested. We may also send you certain non-promotional communications regarding ZMA and our Services and, to the extent permitted by law, you will not be able to opt out of those communications (e.g., communications regarding updates to our Terms or this Privacy Policy).
We maintain “do-not-call” and “do-not-mail” lists as mandated by law. We process requests to be placed on do-not-mail, do-not-phone and do-not-contact lists within 60 days after receipt, or such shorter time as may be required by law.
“Do Not Track” preference
Do Not Track is a privacy preference that users can set in certain web browsers. Do Not Track is a way for users to inform websites and services that they do not want certain information about their webpage visits collected over time and across websites or online services. Please note that we do not respond to or honor Do Not Track signals or similar mechanisms transmitted by web browsers.
Cookies and interest-based advertising
As noted above, you may stop or restrict the placement of cookies on your computer or remove them from your browser by adjusting your web browser preferences. On many mobile devices, application users may opt out of certain mobile advertisements via their device settings.
The online advertising industry also provides websites from which you may opt out of receiving targeted ads from our data partners and our other advertising partners that participate in self-regulatory programs. You can access these, and learn more about targeted advertising and consumer choice and privacy, at https://thenai.org/opt-outwww.youronlinechoices.eu/ or www.youradchoices.ca/, and www.aboutads.info/choices/. You can also choose not to be included in Google Analytics here.
Whether you are using our opt-out or an online industry opt-out, these cookie-based opt-outs must be performed on each device and browser that you wish to have opted out. For example, if you have opted out on your computer browser, that opt-out will not be effective on your mobile device. You must separately opt out on each device.
Advertisements on third party websites that contain the AdChoices link, and that link to this Privacy Policy, may have been directed to you based on anonymous, non-personal information collected by advertising partners over time and across websites. These advertisements provide a mechanism to opt out of the advertising partners’ use of this information for interest-based advertising purposes.
Rights of access to and correction, erasure, and restriction of, data
Where permitted by applicable law, you may inquire as to whether ZMA is processing personal information about you, request access to personal information, and ask that we correct, amend or delete your personal information where it is inaccurate or has been processed in violation of your rights under data privacy laws that apply in the country where you live. Where otherwise permitted by applicable law, you may send an e-mail to info@zaixma.com or use any of the methods set out in this Privacy Policy to request access to, receive, seek correction/ modification, or request erasure of personal information held about you by ZMA. Please include your full name, email address associated with your account and a detailed description of your data request. Such requests will be processed in accordance with applicable law.
Although ZMA makes good faith efforts to provide Users with access to their personal information, there may be circumstances in which ZMA is unable to provide access, including but not limited to: where the information contains legal privilege, would compromise others’ privacy or other legitimate rights, where the burden or expense of providing access would be disproportionate to the risks to the User’s privacy in the case in question or where it is commercially proprietary. If ZMA determines that access should be restricted in any particular instance, we will provide you with an explanation of why that determination has been made and a contact point for any further inquiries. To protect your privacy, ZMA will take commercially reasonable steps to verify your identity before granting access to or making any changes to your personal information.
How long we keep data
ZMA retains the personal information we receive as described in this Privacy Policy for as long as you use our Services or as necessary to fulfill the purpose(s) for which it was collected, provide our Services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements and comply with applicable laws. When we are no longer required to retain your personal information as described above, we will destroy, erase, or de-identify it in accordance with our data retention policies and applicable law. Legal requirements, however, may require us to retain some or all of the personal information we hold for a period of time that is longer than that for which we might otherwise hold it.
Security of your information
We take steps to ensure that your information is treated securely and in accordance with this Privacy Policy. We maintain commercially reasonable administrative, technical and physical safeguards (which vary depending on the sensitivity of the personal information) designed to protect against unauthorized use, disclosure or access of personal information. Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us. We do not accept liability for unintentional disclosure.
By using the Services or providing personal information to us, you agree that we may communicate with you electronically regarding security, privacy and administrative issues relating to your use of the Services. If we learn of a security breach, we may attempt to notify you electronically by posting a notice on the Services or sending an email to you. You may have a legal right to receive this notice in writing.
Governing law and jurisdiction; international users
By using the Services, you consent to ZMA’s transfer of your data to the United States. By choosing to visit the ZMA Site, use the Services, or otherwise provide information to us, you agree that any dispute over privacy or the terms contained in this Privacy Policy will, to the extent permitted by law, be governed by the laws of the State of Californa, without regard to principles of conflicts of law. Any disputes arising in connection with this Privacy Policy will be handled in accordance with the dispute resolution provisions in the Terms.
If you are visiting from the European Union or other regions with laws governing data collection and use, please note that you are agreeing to the transfer of your information to the United States and to the processing of your data globally. By providing your personal information, you consent to any transfer and processing in accordance with this Privacy Policy.
Children’s privacy
ZMA encourages parents and guardians to supervise their child’s use of the Internet. We urge parents to instruct their children to never give out their real names, addresses, phone numbers, or other personal information without a parent’s or guardian’s permission when using the Internet. We recognize a special obligation to protect personal information obtained from children and by design do not collect this information. For this reason, ZMA does not knowingly request, collect, or store any personal information from children under 18.
In compliance with COPPA (the Children’s Online Privacy Protection Act), we have adopted the following policies to keep children safe (there are exceptions to these policies as noted below under the heading “Exceptions to Verifiable Parental Consent and Information Collected from Children”):
  • We will not knowingly collect, use, or distribute personal information from children under the age of 18 without prior verifiable consent from a parent or guardian.
  • We will not knowingly ask a child under the age of 18 to divulge more information than is needed to participate in any aspect of the Services.
  • We will not knowingly keep any personal information that is inadvertently included in a child’s email submission, help inquiry, or other one-time request, if we know that the child is under the age of 18. Any such information will be purged promptly after the issue has been resolved.
  • We will not knowingly post any personal information that is inadvertently included in a child’s submission to a general audience contribution area if we know that the child is under the age of 18. Upon notice to us, these submissions will be deleted and such submissions will be handled anonymously thereafter.
  • We will not knowingly provide any direct link to websites that are unsuitable for minors.
Upon request, ZMA will provide a parent or guardian with a description of the information that may have been provided about their child during a registration process for a program or service of this site. If we have collected and stored personal information from a child, we will give parents the ability to review their child’s personal information, request that we discontinue further collection or use of their child’s personal information, and/or request that we delete their child’s personal information.

PARENTS ARE REQUIRED TO SUPERVISE MINORS’ USE OF THE SITE
We require parents/guardians to supervise any minors participating in any aspect of the Services through the parent or guardian’s account. Minors are not eligible to register accounts on the ZMA Site. We also require that users not use personally identifying information of minors in usernames or other publicly visible portions of the Services, or portions of the Services visible to other registered users. During registration, we ask users whether minors in their households or under their care will be using the Services through the parent/guardian’s account as permitted in the Terms. If users indicate that minors will use the Services through the parent/guardian’s account, we will require the parent or guardian to execute a waiver and release on behalf of him-, her-, or theirself and on behalf of the minor(s).

  • If you are a California resident under the age of 18 and a registered user of the ZMA services, you may request and obtain removal of content or information you have publicly posted on the Services. To make this request, please email us at info@zaixma.com and include a detailed description of the specific content or information you would like to remove. Please note that this removal does not ensure complete or comprehensive removal of the content or information posted on the ZMA services by you as there may be circumstances in which the law does not require or allow removal.
  • Beginning January 1, 2020, the California Consumer Privacy Act of 2018 (“CCPA”) provides California residents with additional rights as described below. Please note your right to know and right to delete are subject to certain exceptions under the CCPA.
  • Disclosures About Your Personal Information. We collect the following categories of personal information, as defined in the CCPA, from or about you and may have disclosed this information for a business purpose:
    • Identifiers, such as your name, IP address, email, and other similar identifiers;
    • Personal information categories listed in the California Customer Records provision, such as payment information;
    • Characteristics about you, such as age and gender;
    • Commercial information, such as the ZMA subscription(s) you purchase;
    • Internet or other electronic network activity information, such as your activity on the ZMA Site;
    • Audio, electronic, visual, or other similar information; and
    • Inferenced-based on the information we collect from or about you which we use to better understand your preferences and behavior, including advertising for you.
  • Our Privacy Policy includes additional information about our data practices. You can learn more about the categories of personal information we collect from or about you and the categories of sources from which we collect this information in Section 3 (“Types of information we collect”), the business or commercial purposes for collecting this information in Section 4 (“How we use information we collect”), and the categories of third parties with whom we have shared personal information for a business purpose in Section 7 (“information we share”).
  • Right to Know. You have the right to request that we disclose to you the categories and specific pieces of personal information we have collected about you as well as information about how we collect, use, disclose, and “sell” personal information.
  • Right to Delete. You have the right to request the deletion of personal information that we collect or maintain about you and your account. Please note that requesting deletion will require the cancellation and deletion of your account which, upon completion, cannot be undone.
  • Right to Opt Out of “Sale.” ZMA may disclose certain information about you if you are a registered user of the Services for purposes that may be considered a “sale” under the CCPA. For example, we may disclose information to advertising partners, advertising technology companies, and companies that perform advertising-related services in order to provide you with more relevant advertising tailored to your interests on the Services.
